SONORAN RESERVE LLC — MEMBERSHIP TERMS OF SERVICE
Effective date: September 1, 2026. These Terms govern all Sonoran Reserve water delivery memberships. By purchasing a membership, you agree to these Terms.
1. MEMBERSHIP AND RECURRING BILLING. Memberships are monthly subscriptions. The payment method on file is charged automatically each month at the rate shown at checkout until the membership is paused or cancelled. You may pause, modify, or cancel at any time through your member account or by contacting us.
2. BOTTLE OWNERSHIP. All bottles, and all other equipment provided by Sonoran Reserve, remain the sole property of Sonoran Reserve LLC at all times. Bottles are provided for member use during an active membership only and are not sold, gifted, or otherwise transferred.
3. BOTTLE EXCHANGE. Following your initial delivery, service is provided on a one-for-one exchange basis: full bottles are delivered in exchange for an equal number of empty bottles returned. If empty bottles are not set out and accessible when our driver arrives during your scheduled delivery window, the driver will leave only as many full bottles as empty bottles received. The undelivered balance of your order will be fulfilled at your next scheduled delivery; no credits or refunds are issued for bottles undelivered due to unavailable empties. The full monthly membership rate applies in every billing cycle regardless of the number of bottles actually exchanged; membership fees are not prorated, reduced, or refunded on account of a delivery that is partially or wholly unfulfilled due to unavailable empties.
4. CANCELLATION AND BOTTLE RETURN. Upon cancellation, a final pickup of all Sonoran Reserve bottles in your possession will be scheduled. Bottles not returned at or within fourteen (14) days of the scheduled final pickup are billed to the payment method on file at a replacement cost of $40.00 per bottle. You authorize this charge as part of these Terms.
5. SERVICE AREA AND DELIVERY. Service is available only within our published delivery ZIP codes in Scottsdale, Paradise Valley, and Arcadia, Arizona. Deliveries occur during the delivery window selected at checkout. Delivery dates may be adjusted for holidays, weather, or operational needs, with notice to you.
6. WATER AND EQUIPMENT CARE. Store bottles indoors or in shade, away from direct sunlight. Sonoran Reserve sanitizes and inspects every bottle before refill; damaged bottles are retired from service. Bottles broken, chipped, cracked, or otherwise damaged beyond serviceable condition while in a member’s possession, and bottles returned in such condition, are subject to the same $40.00 per-bottle replacement charge, billed to the payment method on file.
7. CHANGES. We may update these Terms with reasonable notice. Continued membership after notice constitutes acceptance. Price changes never affect an active member’s rate without prior written notice.
8. WEBSITE USE AND CONTENT. The content of this website is provided for general information about our services and is subject to change without notice. Product availability, delivery areas, and delivery days may change, and all orders are offers to purchase that Sonoran Reserve LLC may accept or decline. Nothing on this website constitutes medical or health advice.
9. DISCLAIMER OF WARRANTIES. EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS OR REQUIRED BY APPLICABLE LAW, THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THIS DISCLAIMER DOES NOT AFFECT WARRANTIES THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW OR OUR COMMITMENTS REGARDING THE QUALITY AND SAFETY OF OUR WATER.
10. LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, SONORAN RESERVE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE WEBSITE, MEMBERSHIP, OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A MEMBERSHIP WILL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
11. INDEMNIFICATION. You agree to indemnify and hold harmless Sonoran Reserve LLC and its members, managers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the services, except to the extent caused by our own negligence or misconduct.
12. GOVERNING LAW AND VENUE. These Terms and any dispute arising out of or relating to them or the services are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction, and each party consents to personal jurisdiction and venue in those courts.
13. ENTIRE AGREEMENT; SEVERABILITY; NO WAIVER. These Terms, together with our Privacy Policy and any policies referenced at checkout, are the entire agreement between you and Sonoran Reserve LLC regarding the services. If any provision is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
